Artist Terms & Conditions

1. Scope and relationship to other terms

These Artist Terms & Conditions ("Artist Terms") apply to you as an artist, band, or artist representative ("Artist," "you") using SoundSpire, operated by Ashish Paul ("SoundSpire," "we," "us," "our").

They are in addition to our general Terms of Service and Privacy Policy, which are incorporated by reference. If there's a direct conflict on an artist-specific matter, these Artist Terms control.

2. Artist accounts and eligibility

• You must be at least 18 years old, or the age of majority in your jurisdiction, to register as an Artist.
• You confirm that the information you provide about yourself and your act is accurate, and that you are authorized to represent the artist or entity you're onboarding.
• You're responsible for activity on your Artist account and for the security of your credentials.

3. What you can do on SoundSpire

Through your Artist account you can build a community hub, share exclusive content with your fans (free of charge, at your discretion), interact directly with your audience, and appear across the discovery and reviews layer.

We may add, change, or remove Artist features over time. Any feature that requires a separate agreement will be governed by additional terms presented to you before you use it.

4. Your content and ownership

"Artist Content" means everything you upload or share through your Artist account - including music, audio, video, images, artwork, text, and community posts.

• You retain all ownership of your Artist Content and the underlying rights.
• You grant SoundSpire a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, display, distribute, and promote your Artist Content within the Services and in connection with operating and promoting SoundSpire and your presence on it (for example, in-app placement, discovery, and platform promotional materials).
• This license lasts while your Artist Content is on the Services and for a reasonable period afterward to the extent needed for backups, distribution already in progress, or content fans have saved or reshared within the Services.
• We are not obligated to publish, keep, or promote any particular content.

5. Your representations and warranties

You represent and warrant that, for all Artist Content you upload:

• you own it or have all necessary rights, licenses, and permissions to upload it and to grant the license in Section 4;
• it does not infringe any copyright, trademark, publicity, privacy, or other right of any third party;
• you have secured any required clearances from co-writers, producers, featured artists, collaborators, labels, publishers, and rights holders, and cleared any samples;
• it does not contain unlawful, defamatory, or otherwise prohibited material.

You are solely responsible for your Artist Content and for any claims arising from it.

6. Running your community

If you operate a community hub, you act as its host. You agree to:

• set a welcoming tone and moderate reasonably;
• follow, and help your members follow, our acceptable-use rules and community standards;
• not use the community to harass, deceive, or exploit fans, or to distribute prohibited or infringing content.

We may provide moderation tools, but you remain responsible for your space. We may step in, remove content, or suspend a community that breaches these terms or the law.

7. Prohibited conduct

In addition to the general acceptable-use rules, you agree not to:

• misrepresent your identity, catalogue, or rights;
• upload content you don't have the rights to;
• artificially inflate followers, engagement, reviews, or ratings;
• solicit fans off-platform in ways that violate applicable law or these terms;
• use SoundSpire to promote another party's rights or content without authorization.

8. Content moderation and removal

We may review, moderate, remove, or restrict Artist Content or Artist accounts that breach these Artist Terms, our general Terms, or the law, or that create legal or reputational risk. Where practical and lawful, we'll aim to give you notice. We will act promptly on valid copyright or rights-holder complaints and may terminate repeat infringers.

9. Indemnity

You agree to indemnify and hold harmless SoundSpire and its team from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Artist Content, your use of the Services, your community, or your breach of these Artist Terms or of any third party's rights - including intellectual-property and rights-clearance claims.

10. No employment, agency, or partnership

Nothing in these Artist Terms creates an employment, agency, joint-venture, or partnership relationship between you and SoundSpire. SoundSpire is a platform; it does not act as your manager, label, agent, or representative, and does not guarantee any audience, reach, or outcome.

11. Term and termination

• You may stop using your Artist account and delete it at any time.
• We may suspend or terminate your Artist account if you breach these terms, create risk or legal exposure, or if we discontinue the Services or a feature.
• On termination, the license in Section 4 winds down as described there. Sections that by their nature should survive (ownership, warranties, indemnity, disclaimers, liability limits, governing law) will survive.

12. Disclaimers and liability

The Services are provided "as is" and "as available." SoundSpire makes no warranty about audience size, engagement, discovery, or any commercial result. The disclaimers and limitation-of-liability provisions in the general Terms of Service apply to you as an Artist.

13. Governing law and disputes

These Artist Terms are governed by the laws of India, and the courts of Mumbai, Maharashtra, India will have jurisdiction, subject to any mandatory rights under your local law.

14. Changes

We may update these Artist Terms from time to time. We'll post the updated version with a new "Last updated" date and give notice of material changes where required. Continuing to use your Artist account after an update means you accept the revised Artist Terms.
